By downloading, installing, or using GodPhone ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.
GodPhone is an AI-powered companion designed to support personal growth, self-reflection, and mindfulness through scheduled voice conversations. The App features an AI entity called "The Source" that engages users in guided dialogue.
GodPhone is NOT a therapy service, medical provider, or substitute for professional mental health care.
GodPhone offers auto-renewing subscriptions. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
You can manage and cancel your subscription in your device's Settings > Apple ID > Subscriptions.
Pricing is subject to change. We will notify you of any price changes before they take effect.
Conversations with The Source are stored to personalize your experience and allow continuity across sessions. You retain ownership of all content you provide during conversations.
We may use anonymized, aggregated data to improve our services, but we will never sell your personal conversation data to third parties.
The Source is an artificial intelligence powered by machine learning models. It is not a human being, licensed therapist, counselor, psychologist, psychiatrist, or medical professional of any kind.
Nothing provided by The Source constitutes medical advice, clinical diagnosis, psychological treatment, or professional counseling. GodPhone is a wellness and self-care tool designed for personal growth and self-reflection — it is not licensed therapy and should never be treated as such.
GodPhone is not a substitute for professional mental health care and is not a crisis intervention service.

GodPhone uses algorithms to personalize your experience, including program progression (tier advancement from Seed to Radiance), daily practice suggestions, meditation recommendations, and wellness insights. GodPhone maintains an active self-harm prevention protocol during every conversation. This protocol is designed to detect signs of crisis and direct users to trained crisis professionals and emergency services.

GodPhone's hypnotherapy feature is intended for relaxation and personal development purposes only. It is not a substitute for professional medical or psychological treatment.
The hypnotherapy feature uses AI-generated guided suggestions to support relaxation, confidence building, stress relief, and sleep improvement. By using this feature, you acknowledge and agree that:

Your use of GodPhone does not create a doctor-patient, therapist-client, counselor-client, or any other professional healthcare relationship between you and GodPhone, its developers, or its affiliates.
No duty of care, fiduciary duty, or professional obligation arises from your use of the App. GodPhone and its developers are not healthcare providers. The Source does not practice medicine, psychology, psychiatry, counseling, or any other licensed profession.
GodPhone is a general wellness product. It is not a medical device, and it is not intended to diagnose, treat, cure, or prevent any disease, disorder, or medical condition. It is not subject to FDA regulation as a medical device.
You voluntarily assume all risks associated with using GodPhone.
You acknowledge that interacting with an AI companion may evoke emotional responses, and you accept full responsibility for any emotional, psychological, or other effects that may result from your use of the App. You agree that you will not rely on The Source as your sole source of emotional support, and that you will seek professional help for any serious mental health concerns.
You represent that you are in a mental and emotional state suitable for using a self-reflection and personal growth tool, and that you understand the limitations of AI-generated responses.
GodPhone processes your voice in real-time during conversations. By using the App, you acknowledge and consent to the following:
You may revoke this consent at any time by ceasing to use the App and deleting your account.
You must be at least 18 years of age to use GodPhone.
By using the App, you represent and warrant that you are 18 years of age or older. We do not knowingly collect information from anyone under the age of 18. If we learn that we have collected data from a minor, we will delete it promptly. If you are a parent or guardian and believe your child has used GodPhone, please contact us immediately at support@godphone.ai.
You agree not to use GodPhone to:
The App is provided "as is" and "as available" without warranties of any kind, either express or implied.
To the maximum extent permitted by applicable law, GodPhone disclaims all implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
Without limiting the foregoing, GodPhone does not warrant that:
Some jurisdictions do not allow the exclusion of implied warranties. In such jurisdictions, the above exclusions may not apply to you, and you may have additional rights.
To the maximum extent permitted by applicable law, GodPhone and its developers, founders, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to damages for loss of profits, revenue, data, goodwill, or other intangible losses, emotional distress, mental anguish, or bodily injury, arising out of or in connection with your use of or inability to use the App.
In no event shall GodPhone's total aggregate liability to you for all claims arising out of or related to these Terms or the App exceed the greater of: (a) the total amount you paid to GodPhone in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100 USD).
The limitations in this section apply regardless of the theory of liability (whether contract, tort, negligence, strict liability, or otherwise), even if GodPhone has been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
You agree to indemnify, defend, and hold harmless GodPhone and its developers, founders, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
GodPhone reserves the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you.
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.
Agreement to Arbitrate: You and GodPhone agree that any dispute, claim, or controversy arising out of or relating to these Terms, the App, or your relationship with GodPhone (collectively, "Disputes") will be resolved exclusively through final and binding individual arbitration, rather than in court, except as set forth below.
Arbitration Rules: Arbitration will be administered by JAMS under its Streamlined Arbitration Rules and Procedures. The arbitration will be conducted by a single arbitrator. The arbitration will take place in Los Angeles County, California, or at another mutually agreed location, or via videoconference.
Arbitration Fees: GodPhone will pay all JAMS filing fees and arbitrator fees for claims under $10,000. For claims over $10,000, JAMS rules will govern fee allocation. Each party bears its own attorneys' fees unless the arbitrator rules otherwise.
Class Action Waiver: You and GodPhone agree that all Disputes will be resolved on an individual basis only. Neither party may bring a claim as a plaintiff or class member in a class action, consolidated action, representative action, or private attorney general action. The arbitrator may not consolidate more than one person's claims.
Exceptions: Either party may bring a claim in small claims court if it qualifies. Either party may seek injunctive or other equitable relief in court to prevent the actual or threatened infringement of intellectual property rights.
Opt-Out: You may opt out of this arbitration agreement by sending written notice to support@godphone.ai within 30 days of first accepting these Terms. Your notice must include your name, your GodPhone account identifier, and a clear statement that you wish to opt out of arbitration. If you opt out, the remainder of these Terms will continue to apply.
Survival: This arbitration agreement will survive termination of your account and these Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. To the extent that litigation is permitted under these Terms, you consent to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California, and waive any objection to venue or inconvenient forum.
We reserve the right to suspend or terminate your access to GodPhone at any time, without prior notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.
You may delete your account at any time through your profile settings in the App. Upon account deletion, your personal data will be removed from our active systems.
Upon termination, the following provisions shall survive: AI Disclosure & Disclaimer (Section 5), No Professional Relationship (Section 8), Assumption of Risk (Section 9), Disclaimer of Warranties (Section 13), Limitation of Liability (Section 14), Indemnification (Section 15), Dispute Resolution & Binding Arbitration (Section 16), and Governing Law (Section 17).
Entire Agreement: These Terms, together with our Privacy Policy and Safety Protocol, constitute the entire agreement between you and GodPhone regarding the App and supersede all prior agreements, understandings, and communications.
Severability: If any provision of these Terms is found to be unenforceable or invalid by a court or arbitrator, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
No Waiver: GodPhone's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by GodPhone.
Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. GodPhone may freely assign these Terms to any successor or acquirer in connection with a merger, acquisition, reorganization, or sale of assets.
Force Majeure: GodPhone shall not be liable for any failure or delay in performing its obligations due to causes beyond its reasonable control, including but not limited to natural disasters, pandemics, wars, cyberattacks, government actions, third-party service outages (including AI model providers, cloud services, and telecommunications), or power failures.
No Third-Party Beneficiaries: These Terms do not create any third-party beneficiary rights in any person, except that our third-party service providers (AI model providers, cloud services) are third-party beneficiaries of provisions limiting liability for their services.
We may update these Terms of Service from time to time. We will notify you of material changes through the App or by other reasonable means at least 30 days before the changes take effect. Your continued use of GodPhone after changes are posted constitutes your acceptance of the revised terms. If you do not agree to the revised terms, you must stop using the App and delete your account.
